Regulations of the ForexRev.pl Information Service

§ 1. General provisions

  1. These regulations, hereinafter referred to as the “Regulations”, define the rules for using the website located at the URL address http://forexrev.pl, hereinafter referred to as the “Website”.
  2. The website is operated by Semanticad Sp. z o. o., hereinafter referred to as the “Administrator”.
  3. Website address and contact details: internet address – forexrev.pl e-mail – [email protected], telephone number 510 771 442, correspondence address – ul. Zacisze 7/9, 31-156 Kraków.
  4. Only natural persons with full legal capacity, legal entities and organizational units referred to in Article 33 1 of the Civil Code are authorized to use the Website and the services offered through it.
  5. Each person should read the Regulations before using the Website.

 

§ 2. Types and scope of services provided on the Website

  1. The following information services are offered via the Website:
  2. Data and statistics about Forex brokers and Binary Options brokers.
  3. Ratings, opinions or comments of website users about brokers available on the website (hereinafter referred to as Studies).
  4. Discussions about available brokers.
  5. News from the currency markets.

 

§ 3. Privacy Policy

  1. By completing the form and checking the box next to the appropriate declaration, the User consents to the collection and processing of his or her personal data in accordance with the Personal Data Protection Act of 29 August 1997 ( Journal of Laws of 2015, item 2135, as amended ) by the Administrator for the purposes necessary to implement the provisions of these Regulations and the services provided thereunder.
  2. The Controller of Personal Data is Semanticad Sp. z o. o. with its registered office at: ul. Zacisze 7/9, 31-156 Kraków. Entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for Kraków Śródmieście in Kraków, 11th Commercial Division of the National Court Register, under number: 0000596683, Tax Identification Number (NIP): 6762499774.

  1. Only personal data provided by the User voluntarily is collected. The data is processed for the purposes necessary to implement the provisions of these Terms and Conditions, in particular to:
    • storing the User’s personal data in the User database,
    • monitoring website traffic.
  2. With the additional consent granted by the User, the collected personal data may also be used for promotional and marketing purposes, including in particular for the purpose of presenting the User with the commercial offer of the Website and other marketing information related to the Website.
  3. If you subscribe to the newsletter and consent to receive it during the registration or ordering process (consent to receiving commercial information electronically), you only need to provide an email address to which commercial information from the Administrator will be sent. You may unsubscribe from receiving such information at any time by logging into your account on the Website or clicking the unsubscribe link in the footer of each newsletter.
  4. Users have the right to access their personal data at any time and to correct, amend, update, or request its deletion. To do so, please send us an email at [email protected];
  5. The Administrator informs that the User is not obliged to provide his/her personal data, however, refusal to provide them will prevent the proper performance of the services specified in the Regulations for the User.
  6. Collected data is carefully protected in accordance with applicable regulations. The Administrator makes every effort to ensure the appropriate level of security for the stored data.
  7. The Website uses cookies. When a Customer visits the Website, the Website’s system sends at least one cookie to the Customer’s computer to uniquely identify the browser. The Website server automatically records information sent by the Customer’s browser when viewing websites. Server logs may contain information such as network request, IP address, browser type and language, and the date and time of the request. This information allows us to improve the quality of our services by identifying and storing Customer preferences and tracking trends, such as how our website is searched. Customers can refuse to receive cookies, thereby remaining anonymous. However, by disallowing cookie registration, the Website will not be able to identify the Customer or their preferences. Detailed information about cookies can be found in the Cookies Policy available in the Cookies tab.
  8. The Website informs Customers that the services offered through the Website are provided via the public internet. Therefore, the Website draws Customers’ attention to the fact that using the Website’s services may involve risks related to third-party interference in the transmission of data sent via the internet between the Website and the Customer.
  9. Data is never and will never be transferred to third parties, but may be disclosed to authorized bodies upon request. Any files sent to us will be used solely for the purpose of providing the service. They will never be shared with third parties.
  10. The website uses cookies to:
    • remember your display preferences;
    • creating statistics and viewership reports on the operation of the Website.
    • In order to configure the options of your device regarding consent to the storage of cookies and to specify the scope of cookies stored, the User may change the settings of the web browser used.
  11. The Website informs that failure to change cookie settings by the User means that they will be stored on the User’s end device. In such a case, the Website may store information on the User’s end device and access this information.

  13. The following types of cookies are used within the Website:
    • count – cookies responsible for recording the number of visits to the website;
    • cookie of the WordPress plugin WP-SpamFree – cookies that prevent spam from being sent via the comment form;
    • w3tc_referrer – a cookie from the WordPress Total Cache plugin designed to improve website performance;
    • Google Analytics Cookie;
    • browser window settings cookie;
    • cookie used to change the appearance of the website to high contrast.

 

§ 4. Technical requirements

  1. In order to ensure proper and uninterrupted use of the Website and the provision of services to the User, the User’s terminal station/device should meet the following minimum technical requirements:
    • active internet connection,
    • 800 MHz processor or higher, RAM at least 512 MB,
    • Operating system at least Windows 98
    • cookie and Java Script acceptance enabled
  2. The Service is not obligated to provide the above devices and/or software.
  3. The installation of the software referred to in paragraphs 1 and 2 is subject to a separate license agreement between the User and the licensor.

 

§ 5. Responsibility of the administrator

  1. No information on the Website may be considered as recommendations regarding financial instruments of their issuers or exhibitors within the meaning of the Act on Trading in Financial Instruments of 29 July 2005 and the Regulation of the Minister of Finance on information constituting recommendations regarding financial instruments, their issuers or exhibitors of 19 October 2005.
  2. The information contained within the Website does not constitute legal or financial advice.
  3. The studies published on the Website constitute solely an expression of the views of its users and should not be interpreted otherwise.
  4. The user of the information makes the decision independently, and the Administrator does not bear any responsibility for the possible use of this information when making investment decisions.
  5. The Administrator is not responsible for the content of the Works added by Users of the Website.
  6. Furthermore, the Administrator reserves the right to remove or not publish a Submission if, in the Administrator’s opinion, it is fictitious, untrue or offensive.
  7. The User declares that he/she has read and understood the rules of operation, and in particular the principles of liability applicable on the Website.

§ 6. Complaints

  1. The User has the right to submit a complaint regarding matters related to the services provided electronically by the Website to the User.
  2. Complaints can be submitted electronically to the Website’s email address: [email protected] , entering “Complaint” in the subject line.
  3. The complaint should include at least the name and surname, the subject of the complaint and the circumstances justifying the complaint.
  4. Complaints will be considered within 14 days from the date of their submission. The Website will notify the User about its decision as a result of considering the complaint via the same method used by the User to submit the complaint and also to the e-mail address provided in the complaint.

 

§ 7. Final provisions and description the possibility of using out-of-court methods of settling complaints and pursuing claims

  1. The provisions of these Regulations are not intended to exclude or limit any rights of the User who is also a Consumer granted to him under mandatory provisions of law. In the event of any inconsistency between the provisions of these Regulations and the above provisions, these provisions shall prevail.
  2. In matters not regulated by these Regulations, the provisions of Polish law shall apply, in particular the Act of 30 May 2014. on consumer rights (Journal of Laws of 2014, item 827 of 24 June 2014) and the Act of 23 April 1964. – Civil Code (Journal of Laws 2014, item 121, as amended ).
  3. The Regulations are available on the Website and are effective from February 1, 2016.
  4. The name of the Website, its concept, graphic design and databases are the property of the Administrator and are subject to legal protection.
  5. Information on the possibility for a User who is a consumer to use extrajudicial methods of dealing with complaints and pursuing claims as well as the rules of access to these procedures are available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Trade Inspection and at the following internet addresses of the Office of Competition and Consumer Protection:

The user who is a consumer has, among others: the following possibilities of using extrajudicial means of settling complaints and pursuing claims:

  • Permanent consumer arbitration court operating at the Trade Inspection – the possibility of filing a request to resolve a dispute arising from the concluded Sales Agreement;
  • the provincial inspector of the Trade Inspection may request the initiation of mediation proceedings in an amicable settlement until the dispute between the User and the Website is resolved;
  • district (municipal) consumer ombudsman or social organization whose statutory tasks include consumer protection (e.g. Consumer Federation, Association of Polish Consumers). Advice is provided by the Consumer Federation on the toll-free consumer hotline number 800 007 707 and by the Association of Polish Consumers at the email address [email protected]
